A. Instruction on the Right of Withdrawal

Introduction

Consumers have a right of withdrawal under the following conditions, whereby a consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither attributable to their commercial nor their independent professional activity:

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.  
The withdrawal period is fourteen days from the day on which you or a third party designated by you, who is not the carrier, have taken possession of the last goods.  
To exercise your right of withdrawal, you must notify us (Hosta Werk für SchokoladeSpezialitäten GmbH & Co. KG, Greutstr. 9, 74597 Stimpfach, Deutschland, Tel.: 07967-1530, E-Mail: info@hosta-group.com) inform us of your decision to withdraw from this contract by means of a clear statement (e.g., a letter sent by post or email). You may use the attached model withdrawal form, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send the communication concerning the exercise of the right of withdrawal before the withdrawal period expires.

Consequences of the withdrawal

If you revoke this contract, we will refund to you all payments we have received from you, including delivery costs (except for the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery we offer), without delay and no later than fourteen days from the day on which the notification of your revocation of this contract has been received by us. For this refund, we will use the same payment method that you used in the original transaction, unless expressly agreed otherwise with you; in no case will you incur any fees for this refund. We may withhold the refund until we have received the goods back or you have provided proof that you have sent the goods back, whichever occurs earlier. You must return the goods immediately and in any case no later than fourteen days from the day on which you inform us of the withdrawal of this contract. The deadline is met if you send the goods before the expiry of the fourteen-day period. You bear the direct costs of returning the goods. You are only responsible for any depreciation in the value of the goods if this depreciation is due to handling them in a way that was not necessary for checking the condition, characteristics, and functioning of the goods.

Exclusion or premature expiration of the right of withdrawal

The right of withdrawal does not exist for contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive or that are clearly tailored to the personal needs of the consumer. The right of withdrawal does not apply to consumers who, at the time of concluding the contract, do not belong to any member state of the European Union and whose sole residence and delivery address at the time of concluding the contract are outside the European Union.
